I wonder how they pay for the photos that independent photographers sell to them. AP doesn&#039;t have a legion of photogs and does buy photos. I can&#039;t conceive of every photographer signing all rights to the AP.

As far as home use, check with Dave Winer and see how much heat he is getting with FlickerFan.</description>

A DMCA takedown was not the tool for the job in this case. The damage here is not a pissing match over &#039;fair use&#039; but the creativity that we will lose from folks who want to create, but won&#039;t because of this sort ACME Rocket used to move a couple of inches, when a light touch will work.

But then, current Copyright Law is FUBAR.

It&#039;s great to see you writing with all of our full powers.

I happen to think this use of IP Right was over reaching: Wendy Seltzer and Lawgeek agree that the use is &quot;defensible&quot; and Lane would be unwise to take it to court.

The public court has ruled her use of the DMCA to been extreme and unreasonable, IMHO.

Lane&#039;s iakge was embedded in a video that comments on a business sector that Lane works for Wired and her image of the key players if central to illustrating that world of happy smiling entrepreneurs.

It was not taken from Lane&#039;s Flickr account. Please correct that.

I wish people would try to discuss this episode without attacking the people at odds over the rights of the image.

The Richter Scales guys are not much of a band commercially. They are more of a bad habit and make almost no money doing soemthing they love.

They tried to work with Lane with the exception of sending her money they don&#039;t have. They might do a benefit and let people discuss the issue and raise some money to say &quot;mea culpa&quot;.</description>
